In short

Backlight is made by SavvyLabs Ltd and provided to you as-is. You may use it to play .gba files you already own. You are responsible for the games and any BIOS you supply and for using them lawfully. Backlight has no account and collects no personal data. These terms set out the rules for using the app.

Acceptance

By downloading or using Backlight you agree to these terms. If you do not agree, please do not use the app. Your use of the app is also subject to the rules of the store you installed it from (the Apple App Store or Google Play).

Licence to use Backlight

SavvyLabs Ltd grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Backlight on devices you own or control, for your own private, non-commercial use. You may not sell, rent, sub-license or redistribute the app, and you may not attempt to misuse it or interfere with its normal operation, except to the extent the law or the licences of its open-source components expressly permit.

Your games and your files

Backlight does not include, find, sell, or download games or a console BIOS, and provides no way to obtain them. You supply the .gba files and any BIOS yourself. You are solely responsible for ensuring you have the legal right to use any game file or BIOS you import — for example a personal backup of a cartridge you own, or homebrew you are licensed to run. You must not use Backlight to infringe anyone's copyright or other rights.

Acceptable use

Use Backlight for its intended purpose and within the law. Do not use it to break the law, to infringe intellectual-property rights, or in any way that could damage or disrupt the app or other people's use of it.

Open-source components

Backlight is built on the open-source mGBA core, licensed under the Mozilla Public License 2.0 (MPL-2.0), together with other open-source components. Those components remain governed by their own licences, which prevail over these terms for that code. The full licence list, and a link to the core source, is in the app under Settings → Help & Legal.

Privacy

Backlight has no account and collects no personal data; everything stays on your device. How that works is described in full in the Privacy Policy and the "Delete your data" page for Backlight.

Disclaimer of warranties

Backlight is provided "as-is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or file, and you use it at your own risk. Nothing in these terms excludes or limits any rights you have as a consumer that cannot be excluded under the law that applies to you.

Limitation of liability

To the fullest extent permitted by law, SavvyLabs Ltd will not be liable for any indirect, incidental, or consequential loss, or for any loss of data (including game files, saves, or save states), arising from your use of, or inability to use, Backlight. Keep your own backups of anything you value. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

Changes to the app and to these terms

We may update Backlight and these terms from time to time. When we change these terms we will update the effective date above and describe the change plainly. Continuing to use the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except where the mandatory consumer law of your country of residence gives you the right to bring proceedings locally.
